The Supreme Court of the United States is the highest court in the federal judiciary of the United States. The Supreme Court could not including the citizenship of blacks, regardless of whether they were enslaved or free, and therefore the rights and privileges it confers on American citizens could not apply to them. The decision was made in the case of Dred Scott, a slave Negro whose owners took him from Missouri , which was a slave state, to the Missouri territory , most of which was designated "free". When his owners brought him back to Missouri, Scott sued his freedom in court, claiming he was taken to an "free" American territory, and, legally, was no longer a slave. Scott sued first in the state court of Missouri, which determined that he was still a slave under its law. He then sued in the federal court of the United States, which decided against him, He then appealed to the Supreme Court of the United States. the court ruled that the blacks "are not included and do not intend to be included under the word 'citizens' in the Constitution and therefore cannot claim any of the rights and privileges that this instrument provides and guarantees to the citizens of the United States.
