LargeMart, Inc. (LargeMart) is a retail store that sells a variety of consumer goods. One day after a significant snow storm, LargeMart re-opened for business. The parking lot was cleared but the entrance to the store was not. Two days later the entrance remained covered with over a foot of snow with ice underneath. Customers had to enter the store using extreme caution. Cautious Clare (Clare) was seriously injured while trying to enter Largemart. She slipped on the snow and ice, hit her head, and was hospitalized. After she recovered, Clare filed a negligence lawsuit against LargeMart.
At trial, Clare introduced the following evidence: 1) photographs of the store entrance the day before the storm which showed it was cler and on the day of her injury which showed vary dangerous conditions; 2) records obtained in Discovery which indicated LargeMart had a snow removal contract with a company but cancelled the contract a month before the storm; 3) testimony from the LargeMart manager which indicated she was instructed to terminate the snow removal contract by LargeMart's CEO to save money.
