C. Takes a subjective case by case approach to the question of incorporation.

D. Takes the same approach to the question of incorporation in all cases.

I say try A there was a lot of important documents that had to be changed when putting rights & laws into place during the colonization of American. Such as The articles confederation, Declaration of Independence, and the bill of rights.
