Hasta la aprobación de la Ley Saenz Peña, la Unión Cívica Radical desarrolló una acción insurreccional como la Revolución de 1890 y la Revolución radical de 1905 en la que junto a los militantes radicales participaron militares de carrera, estos jóvenes oficiales que habían pasado por la etapa de cadetes formados en una disciplina de obediencia a la prusiana.
En la rebelión que estalló el 4 de febrero de 1905, que llegó a la captura del vicepresidente y estuvo a punto de triunfar, también participó una parte del ejército en unión con los sublevados civiles. En la concepción de Yrigoyen los gobiernos del “régimen” eran ilegítimos y rechazaba el propósito del gobierno y del Estado Mayor de profesionalizar en forma estricta la institución y para él, el militar era, ante todo, un ciudadano que tenía el sagrado deber de “ejercitar el supremo recurso de la protesta armada” como reza el manifiesto del 4 de febrero. En conclusión, los radicales consideraban que los militares debían estar sometidos a los civiles, pero solamente a los que defendían, desde el gobierno o desde la oposición, al ideal democrático.
Con el fracaso del golpe de estado de 1905 muchos militares perdieron sus carreras pero Yrigoyen seguía confiando en las fuerzas armadas al punto que convino con el gobierno en que de ellas dependiera el padrón electoral e incluso pidió al gobierno que ellas garantizaran la elección de gobernador de Santa Fe en 1912.
