A Mixed Constitution or Mixed Government is a form of government composed of powers of a monarchy (one who reign over a state or territory for life of by hereditary right like a king or empress), aristocracy (government by a relatively small privileged class, usually with high socioeconomic status), and democracy (government by the people exercised usually through elected representatives).
Some advantages of this type of constitution:
-Rulers can be elected by the citizens and not only acquire their position by inheritance.
-Makes it impossible for other degenerations like anarchy (absence of government) and tyranny (a government in which absolute power is vested in a single ruler) rule a country or region.
-Mixed government might help to stabilize republics and prevent permanent anacyclosis (political evolution from “benign” government to “malignant” government)
Some disadvantages:
-Like the last advantage mentioned this kind of government could also transition from benign to malignant due to corruption, it means this could lead a country to be ruled by tyranny or dictatorship.
-Just as kings and aristocrats abused their political status in the past, democracy can degenerate into pandering (expressing your view in accordance with the likes of a group you are attempting to appeal and gain votes and followers).
-A state could fall in the hand of demagogues (leaders who gain popularity by exploiting prejudice and ignorance among common people to gain power) creating chaos and division in a country.
A constitution is consider a higher law (a moral or religious principle that takes precedence over the laws adopted by society) because constitutional laws are made to help people and should serve as a practical legal criterion conformed with principles like fairness, morality and justice to they are expected to be followed by all.
Some major characteristics of a higher law are:
They are created to regulate behavior.
Serve as mediator of relations between people.
Members of the society may see these rules as peculiar to themselves and not easily or quickly removable, therefore respecting them at all times.
