In 1961 Gideon v. Wainwright was arrested because of stealing money from vending machines in Florida. During his trial, Wainwright requested that an attorney was appointed to represent him since he could not afford one himself; however, the reply he got was that Florida only provided attorneys to indigent defendants who in case they were guilty might face death penalty.

The Florida Supreme Court denied habeas corpus relief.
