The term "Separation of Powers" has been in use around the world almost from ancient times. In fact, nations such as Greece and Rome, had already used this system during their times. However, despite there being evidence of how old the principle of "separation of power" can be, it was brought back, and with force, in 1748, through the book The Spirit of the Laws, written by Baron de Montesquieu. In this book, Montesquieu talked about the doctrine of separation of powers by stating that liberty comes from the separation of the executive, legislative and judicial powers and from autonomy between the three.
This principle of separation of powers was applied in the United States through the establishment of Federalism and it was also used to write the U.S Constitution by James Madison. However, it is also important to state that in the United States the doctrine of separation of powers is not used strictly in all of its sense, as there are functions that overlap in the government that are not contemplated in this doctrine.
